INDICTABLE CRIMES VS. DISORDERLY PERSON OFFENSES

In New Jersey, crimes are categorized as indictable crimes, disorderly person offenses, and petty disorderly offenses, as opposed to felonies or misdemeanors. An indictable offense is considered equal to a felony due to the sentence for this offense being a minimum of one year in prison. Disorderly person offenses and petty disorderly person offenses would be considered equal to misdemeanors.

Indictable crimes are classified by degrees in New Jersey. These degrees range from fourth degree, which typically includes stalking, forgery, and some robbery offenses, to first degree, which includes murder, manslaughter, and rape. The punishment for an indictable crime in New Jersey depends on its degree and can include prison time and a fine.

DUIS AND DRUG CRIMES IN NEW JERSEY

In New Jersey, driving under the influence of alcohol or drugs (DUI) is considered a traffic offense, not a crime. That doesn't make the charges any less serious. A driver caught operating a vehicle with a blood alcohol content (BAC) over 0.08% for the first time can face up to 30 days in prison. Successive charges have even higher penalties. Other traffic offenses can add points to your license and cause your insurance rates to skyrocket. To help you avoid penalties, our lawyers will vigorously challenge any charges using all evidence available.

An accusation of drug use, possession, or distribution can have serious consequences. Our attorneys understand that sometimes good people are just in the wrong place at the wrong time, and we will aggressively work to prove that the state's charges are baseless. In many cases, we are able to steer cases to pretrial intervention programs to keep our clients out of jail. If you have been charged with possessing marijuana, cocaine, or another drug, we can help.
